HEALTH DECLARATION, LIABILITY WAIVER & TERMS AND CONDITIONS

IMPORTANT NOTICE

By booking a class, purchasing a membership, or attending any session at Raecore Pilates Studio (“Raecore”), you confirm that you have read, understood and agree to be bound by the terms set out below.

This agreement forms a legally binding agreement between you and Raecore.

If you do not agree to these Terms and Conditions, you must not book, purchase, or attend any Raecore classes or services.

1. HEALTH DECLARATION

You confirm that you are physically fit and able to participate in Pilates classes, fitness sessions, workshops, events, private sessions and any other activities provided by Raecore.

You are responsible for ensuring that you are medically fit to participate and for disclosing any relevant medical conditions, injuries, illnesses, surgeries, medication, physical limitations, pregnancy, postnatal status or other health concerns which may affect your ability to participate safely.

Raecore instructors are qualified Pilates professionals and are not medical practitioners. Any guidance or instruction provided does not constitute medical advice.

If you experience pain, dizziness, nausea, shortness of breath, discomfort or any unusual symptoms, you must stop immediately and inform the instructor.

2. MEDICAL CLEARANCE

Participation in exercise may involve physical exertion and carries inherent risk.

You are responsible for seeking advice from your GP, doctor, midwife or other healthcare professional before participating where appropriate.

Medical clearance may be required as a condition of participation.

Participation is entirely voluntary and undertaken at your own risk.

3. ASSUMPTION OF RISK

You acknowledge that participation in Pilates and related activities involves inherent risks, including but not limited to:

• Muscular strains and sprains
• Joint injuries
• Falls or loss of balance
• Aggravation of pre-existing conditions
• Cardiovascular complications
• Serious injury
• Death

You voluntarily accept and assume all risks associated with participation.

4. PREGNANCY AND POSTNATAL PARTICIPATION

Pregnant Clients

Clients who have entered their second trimester of pregnancy are not permitted to participate in standard group Pilates classes.

Raecore does not provide prenatal modifications within standard group classes. Clients in their second or third trimester may only attend sessions specifically designed and delivered by an appropriately qualified Prenatal Pilates Instructor.

You must:
• Inform Raecore immediately upon becoming pregnant
• Obtain approval from your healthcare professional prior to participation
• Follow all medical advice provided

Raecore reserves the right to request evidence of medical clearance and refuse participation where such clearance has not been provided.

Postnatal Clients

Following childbirth, clients must:
• Wait a minimum of 6 weeks following a vaginal birth, or 12 weeks following a Caesarean section
• Obtain clearance from their GP, doctor, midwife or healthcare professional before returning to exercise

Clients within this recovery period may only attend specialist Postnatal Pilates classes delivered by a suitably qualified instructor.

Raecore reserves the right to request evidence of medical clearance and refuse participation where such clearance has not been provided.

5. UNDER-18 CLIENTS

Clients under the age of 18 may only participate subject to the following:

• A completed registration process must be in place prior to participation
• Parental or legal guardian consent must be provided
• The parent or legal guardian must sign the waiver form
• The client under 18 must also sign the waiver form personally

Both the client and their parent or legal guardian must sign the waiver form prior to participation. Failure to provide both required signatures will result in refusal of participation.

The parent or legal guardian confirms responsibility for the client’s participation and confirms that all information provided is true, complete and accurate.

6. RELEASE OF LIABILITY

To the fullest extent permitted by law, Raecore, its owners, directors, instructors, employees, contractors, agents and venue providers shall not be liable for any injury, loss or damage arising from participation in classes, sessions, events or use of equipment, except where liability cannot legally be excluded under English law, including liability for death or personal injury caused by negligence.

7. PERSONAL RESPONSIBILITY

You acknowledge that:

• You are responsible for your own physical condition
• You will follow all instructions and studio policies
• You will inform the instructor of any relevant changes to your health
• Exercise modifications may only be provided by appropriately qualified instructors
• Certain exercises may not be modifiable in group classes
• Instructors may refuse participation where safety is a concern

8. CHANGES TO HEALTH STATUS

You agree to inform Raecore immediately of any changes to your health, injury status, pregnancy status or physical condition which may affect your ability to participate safely.

9. EMERGENCY MEDICAL CONSENT

You authorise Raecore staff to seek emergency medical assistance on your behalf where reasonably required.

You are responsible for any associated medical costs.

10. PHOTOGRAPHY AND VIDEO CONSENT

From time to time, photography and video recording may take place during classes, events or studio activities.

These may be used for marketing and promotional purposes, including social media, website content and printed materials.

If you do not wish to appear in any images or recordings, you must notify Raecore in writing prior to attendance at your first class or session.

11. CANCELLATION POLICY

All bookings are final at the point of purchase.

Cancellations made with more than 24 hours’ notice may be rescheduled subject to availability. Refunds will not be issued.

Cancellations made within 24 hours of the scheduled class time and all non-attendance (no-shows) will be charged in full and are non-refundable and non-transferable.

12. MEMBERSHIPS, PAYMENTS, REFUNDS & TRANSFERS

All purchases are non-refundable and non-transferable unless otherwise required by law.

Memberships are subject to a minimum 12-month contractual commitment.

Class packages and memberships must be used within their stated validity period and will not be extended for any reason, including illness, injury, holidays or personal circumstances.

Early termination requests may be considered only in exceptional circumstances and must be supported with evidence.

A minimum of one month’s written notice is required.

Approval of any early termination request is at the sole discretion of Raecore management.

13. RIGHT TO REFUSE PARTICIPATION

Raecore reserves the right to refuse, suspend or terminate participation where:

• Health information has not been disclosed
• Medical clearance has not been provided where required
• Studio policies are not followed
• Behaviour is unsafe or inappropriate
• Participation may pose a risk to safety
• Safety requirements are not met

No refunds will be issued in such circumstances.

14. STUDIO POLICIES

Late Arrival

Clients arriving more than 5 minutes late or after the warm-up has commenced may be refused entry at the instructor’s discretion for safety reasons.

Grip Socks

Grip socks are mandatory for all classes. Entry may be refused if not worn.

Hands-On Corrections

Instructors may use hands-on corrections during class to assist with posture, alignment and technique.

If you do not consent to hands-on corrections, you must inform the instructor at the start of the class before participation begins. By attending without doing so, you are deemed to have consented to hands-on corrections.

15. CODE OF CONDUCT

Clients must behave respectfully at all times. Raecore reserves the right to remove clients or terminate participation for unsafe, abusive, disruptive or inappropriate behaviour without refund.

16. PERSONAL BELONGINGS

Raecore accepts no responsibility for loss, theft or damage to personal belongings brought onto the premises.

17. DATA PROTECTION

Your personal data will be used for booking management, communication, safety and studio operations in accordance with applicable UK data protection legislation and Raecore’s Privacy Policy.

18. FITNESS TO PARTICIPATE DECLARATION

By booking, attending or participating in any Raecore class or service, you confirm and declare the following:

I confirm that all information provided by me is true, complete and accurate.

I understand that failure to disclose relevant medical conditions, injuries, pregnancy or other health concerns may place me at risk and may result in my participation being refused, suspended or terminated.

I acknowledge that Raecore relies on the information I provide when assessing suitability for participation.

19. ACKNOWLEDGEMENT OF AGREEMENT

By booking, purchasing, attending or otherwise participating in any activity at Raecore Pilates Studio, you confirm that you have read, understood and agree to all terms and conditions set out in this document.

If you do not agree, you must not participate in any Raecore Pilates Studio activity.

20. GOVERNING LAW

This agreement is governed by the laws of England and Wales. Any dispute arising in connection with this agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.
